1. The service

SocialWhale is operated by Faz Promotions Limited ("we", "us"), a company registered in England and Wales. SocialWhale provides software tools that help you plan, design and caption social media content for your business. You retain responsibility for reviewing all generated content and for everything you publish on third-party platforms.

2. Your account

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account.

3. Acceptable use

You agree not to use the service to create content that is unlawful, deceptive, infringing, or that violates the policies of the platform you publish to. We may suspend accounts that breach these terms.

4. Content ownership

You own the content you generate with your subscription, subject to the rights of any third-party assets used. We claim no ownership over your published posts.

5. No performance guarantees

SocialWhale is a content-creation tool. We do not guarantee engagement, followers, customers, or revenue of any kind. Outcomes depend on factors outside our control, including your market, effort and platform algorithms.

6. Billing & cancellation

Subscriptions renew automatically until cancelled. Payments are processed by our third-party payment partner, which acts as the merchant of record for your purchase. You can cancel at any time from your account settings; access continues until the end of the paid period. Refunds are handled per our Refund Policy.

7. Limitation of liability

To the maximum extent permitted by law, SocialWhale is provided "as is" and our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for indirect, incidental or consequential damages, or for loss of profits, revenue or data.

8. Changes

We may update these terms from time to time. Material changes will be communicated by email or in-app notice before they take effect.
